Cipro, Levaquin, and Avelox Class Action Lawsuit and Recall — 2016 Settlement News and Lawsuit Overview

Fluoroquinolones have long been known to have numerous issues. Some of these were tendon damage and peripheral neuropathy. However, their warning labels never made mention of the link between the drugs and the side effects. Back in the mid-90s, a group called Public Citizen tried to get warnings on the labels for these drugs. In 2003 the FDA instructed the makers to put warnings on the drugs about this. The makers of these drugs did not. In 2008, they again formally requested that a warning label be put on the drugs. Public Citizen was pushing for a black box label, the strongest warning available. Again, the drug makers did not.

In 2013, the FDA finally required a label change warning of tendon damage and peripheral neuropathy. Later, recent studies came out showing that these drugs can also cause bulging or tearing of the aorta specifically. In May 2016, the FDA mandated that the makers include a black box label on their drugs. The warning shows that using fluoroquinolones regularly increases the risk of serious side effects.

This was too late for most people, though. In the years before proper labels were put into place, many people suffered. Sheri Kellerman filed a lawsuit against Bayer after taking Avelox and developing peripheral neuropathy. Her case is currently pending in the Northern District of California. Karyn Joy Grossman took Levaquin manufactured by Johnson & Johnson and developed peripheral neuropathy. Her case is also pending in California State Court.

Many of the cases were put into the same MDLs #1943 (for Levaquin) and MDL 2642 for all others. More than 2,000 Levaquin cases have been filed against them before U.S. District Judge John R. Tunheim in Minnesota. Many of these lawsuits were settled before trial for undisclosed amounts. Many hundreds are still active. Plaintiffs have accused the defendants of negligence, failure to warn, and even fraud.
