Lipitor Litigation: Status of the Lawsuit & Recent Settlements (Updated for 2016)

Lipitor was originally approved by the Food & Drug Administration (FDA) in 1996. It is claimed to be the most heavily tested drug of all time. However, lawsuits began popping up in 2006 because of the effects of the drug. By 2012, the FDA mandated that Pfizer change the drug warning labels to include more of the risks of the drug. This was revised in 2014 to be more specific about some of the added risks.

Starting as early as 2006, many people filed suit against Pfizer because of their injuries. By mid-2014 there were almost 1000 cases filed. In early 2014 an MDL (#2502) was formed to consolidate the various claims. Pfizer had objected to that but in the end lost their appeal. The case will be tried in the US District Court in South Carolina, overseen by Judge Richard Gergel. As of late 2016 there were close to 3,000 active cases. The complaints allege that Pfizer:

  • ignored the risks of their drug,
  • engaged in negligent conduct,
  • failed to monitor drug treatment,
  • misled consumers via marketing,
  • inadequately labeled the drug

The pharmaceutical company now goes on record as saying they properly list the dangers of Lipitor, but this didn’t happen until the FDA’s 2012 report.
