If you are facing financial hardship because of your Reglan lawsuit, Nova Legal Funding can help. A pre-settlement loan is essentially a cash advance on your lawsuit settlement
Reglan was first was made in the 1960s to treat nausea and vomiting. It was used to treat patients with migraine headaches and the vomiting that came with chemotherapy and surgery. Today it is used to treat acid reflux, migraines, and heartburn. It has even been used to treat morning sickness and to help breast milk production.
However, the drug is also linked to a neurological disorder called tardive dyskinesia that causes involuntary muscle movements. Tardive dyskinesia is a very serious side effect of Reglan. Physical symptoms of TD include lip-smacking, difficulty breathing, and tongue protrusions. Severe cases of this disorder can make it difficult to perform simple tasks like talking, walking, and eating. These symptoms can be worse in people with bipolar disorder and other neurological issues.

Known Side Effects of Taking Reglan
The major side effect of taking Reglan is tardive dykinesia. This is a disease that causes the body to behave in uncontrollable ways. Some of the profound effects of tardive diskinesia include:
- uncontrolled movement of the lips
- tongue protrusion
- rapid blinking
- difficult moving your fingers
- arm and leg movements that aren’t controlled
- problems with breathing
If that wasn’t enough, prolonged exposure to this drug can result in symptoms like that of Parkinson’s Disease. These can include:
- muscle stiffness
- impairment of speech
- the slowing down of body movement
There have been reports of other movement disorders as a result of Reglan as well. These include blepharospasm, ocular deviation, and akathisia, among others.
History of Reglan: Status of Litiation, Recent Settlement and Verdict News
Metoclopramide has been around since the 1960s. It was created to help combat vomiting and other symptoms of GERD. Hospitals began to use it in more severe cases, like the vomiting caused by radiation and some surgical procedures. It was even prescribed to help with morning sickness and help increase milk supply in mothers. It was approved by the FDA in 1985 and was marketed by Wyeth which is owned by Pfizer. The brand name drug Reglan was approved in 1999 and sold in America.
The link between metoclopramide and tardive dykinesia was known since the 70s. However, this link was known to happen after long-term use (more than 3 months). A survey of Reglan patients done in 1985 showed almost 40% took the drug for over a year. Another 46% took it for longer than 3 months.
This is because of two reasons. 1) The manufacturer did not stress to doctors the dangers of using it long-term. Many doctors prescribed the drug to be taken for over a year, much more than was approved. 2) The label did not stress the risks of prolonged use. Patients didn’t realize that taking Reglan for longer periods was dangerous. Even by 2007, the FDA did a study showing a number of patients were prescribed Reglan for long-term use. The study also linked this to the bad side effect.
In 2009 the FDA required Pfizer to re-label their product with a black-box warning. This is the most severe warning. The warning advises patients about the dangers of TD after the use of Reglan and its generic counterparts. The risk is actually 100 times greater than disclosed in prior package inserts for the drug.
Lawsuits have been filed against makers of this drug for decades. According to complaints filed in federal court, Pfizer was accused of negligence, fraud, and deceptive marketing practices. Furthermore, Reglan lawsuits also allege that Pfizer company failed to:
- make sure that Reglan warnings were accurate,
- adequately warn patients and doctors about the dangers of long-term use,
- report all information about the risks of the drug to the FDA,
- engage in proper testing and research practices.
How Much Could My Reglan Case Settle For?
To date, Pfizer has paid millions in compensation to those suffering from TD after taking Reglan. One of the most significant cases involving Reglan appealed to the U.S. Supreme Court. In March 2004, the U.S. Supreme Court ruled in favor of Diana Levine holding Pfizer liable for using a defective label.
In a related suit in 2011, the courts decided that generic versions of Metoclopramide would not be liable for bad labeling as long as it copied the name brand drug’s label exactly. This ruling did not affect Reglan patients directly though. Plaintiffs still have active lawsuits to try to get compensation for their injury.
The amounts aren’t clear, but if your injury from taking Reglan was bad, the settlements could be sizeable.
How Much is My Pradaxa Case Worth?
The first round of settlements has been completed, and most clients have been paid out of the initial settlement. At $650 million to settle roughly 4000 cases, each client was awarded an average of more than $160k.
Attorneys are still gathering new cases, however, to go after as patients are still coming forward who have suffered from the drug. In most cases when there is an initial settlement, future rounds of the settlement could settle for less. This is not always the case. Some patients are being advised to expect comparable numbers to the first settlement.
How Long Will My Reglan Case Take to Settle?
This question is a little harder to answer. Pfizer has been fighting these claims for decades. More than 4,500 civil suits have been filed against the drug manufacturers. Pfizer agreed to settle some of these in 2014, and many clients have received their settlements. There are still clients who have not received money for their suffering.
That’s not uncommon. Pharma companies have large bank accounts that can keep these cases open longer than clients can stay afloat. Bills keep piling up regardless of what happens in the courts. That’s where a pre-settlement loan comes in.
Qualifying For A Loan On Your Reglan Case
Qualifying with Nova Legal Funding is very easy. Depending on the nature of your injuries and the district in which your case is being tried, your loan amount may vary. In order to qualify, you must have taken Reglan, suffered from any of the listed side effects, and have hired a lawyer to represent you in your case.
Anyone who has taken Reglan is at risk of developing TD. The risks increase if you have taken the medication for longer periods of time. Some factors that also increase your risk and will affect your qualification are your age, having a history of diabetes, and suffering from a neurological condition.
